States Where Payday Loans Are Illegal

Three states prohibit payday lending by name. Around twenty more end it with a rate cap. For a borrower the result is the same.

"Illegal" covers two different things. A handful of states prohibit payday lending by name. A larger group caps the annual rate so low that no lender can offer the product profitably, which ends it just as effectively without a ban appearing in the statute. For a borrower the practical result is the same: no licensed payday lender will lend to you there.

What you can borrow in those states

A rate cap on payday lending does not mean no credit is available. In most of these states you can still access:

If a site offers you a payday loan in a prohibited stateTreat it as a warning sign. It is either an unlicensed operator, a lead generator that will sell your details on, or a tribal lender claiming sovereign immunity to sidestep state caps, where APRs can exceed 800%. Check the lender against your state regulator's licensee list before sharing anything, and read how to spot a loan scam.

Where we lend

We offer each product only where we hold the licence for it, which is why payday loans are unavailable on our site in states that prohibit them even though we lend there. See states we serve.

Frequently asked questions

Which states have banned payday loans?

Georgia prohibits payday loans below $3,000, West Virginia does not permit deferred presentment loans, and Connecticut bans the assignment of wages as security. A further group of around twenty states plus the District of Columbia ends the product through rate caps at or below roughly 36% APR.

What happens if I take a payday loan in a state that bans them?

Any lender offering one is either unlicensed, a lead generator, or claiming tribal sovereign immunity to sidestep state caps. Check the lender against your state regulator's licensee list before sharing your details.

Can I still borrow in a state that bans payday loans?

Yes. Installment loans sit under different statutes and remain available in many capped states, as do personal loans, credit union payday alternative loans capped at 28% APR, and cash advance apps.

Are tribal loans legal in states that ban payday lending?

Tribal lenders argue that sovereign immunity places them outside state law, and their APRs can exceed 800% even in capped states. The position is contested and varies, so verify the lender's licensing before borrowing.
